If you have been persecuted or fear you will be persecuted on account of your race, religion, nationality, membership in a particular social group, and/or political opinion, you may qualify for asylum or refugee status in the United States. Acquiring status as an asylee or refugee allows you to subsequently adjust status and become a lawful permanent resident of the United States in the future. Generally, asylum applications must be presented within a year of arriving in the United States. However, if the one-year deadline has passed in your case, you still may be eligible to apply for a similar form of relief known as withholding of removal. If your application for withholding of removal is subsequently granted, you are permitted to remain and lawfully work in the United States. Moreover, the Department of Homeland Security may provide temporary protected status (TPS) to foreign nationals who are temporarily unable to return safely to their country due to ongoing armed conflicts, natural disasters, or other extraordinary conditions. Under TPS, you are no longer considered removable from the United States. Likewise, with TPS, you can legally work in the United States and obtain travel authorization to travel temporarily abroad and return to the U.S. on a later date. Whether you are seeking asylum, withholding of removal, or TPS, our team of experienced, legal professionals will help you successfully present your case.
